Scope of national rule

This Ordinance regulates the safety of lifts in use that have been installed in and permanently serve buildings. ‘Lift’ means a lifting appliance serving specific levels, having a carrier moving along guides which are rigid and inclined at an angle of more than 15 degrees to the horizontal, intended for the transport of:

- persons,

- persons and goods,

- goods alone if the carrier is accessible, that is to say a person may enter it without difficulty, and fitted with controls situated inside the carrier or within reach of a person inside the carrier,

- goods accompanied by an attendant for lifts installed in buildings before 31 March 2006.

- This Ordinance shall also apply to lifts moving along a fixed course even where it does not move along rigid guides (e.g. scissor lifts).

- The rules describe lift inspection and maintenance procedures and the authorisation criteria applicable to the bodies carrying out periodic checks of lifts and the organisations responsible for maintaining lifts and rescuing people therefrom.


Main requirements that the business user needs to know about

Owners of lifts installed in buildings before 31 March 2006 shall work to improve their safety.) When a lift in service is subjected to significant changes altering its characteristics, the said lift shall be deemed a new lift, and it shall meet essential health and safety requirements laid down in the Ordinance on the safety of lifts (NN No. 20/2016). The said Ordinance transposed Directive 2014/33/EU of the European Parliament and of the Council of 26 February 2014 on the harmonisation of the laws of the Member States relating to lifts and safety components for lifts (OJ L 96, 29.3.2014) into the legal system of the Republic of Croatia.

The owner shall ensure both Regular inspections of a lift and Extraordinary inspection of a lift.

Inspections of lifts shall be performed by the authorised organisation with the participation of the lift maintainer.

Maintenance of lifts can be regular or extraordinary.

Regular maintenance of lifts shall be performed at least once a month. Extraordinary maintenance of lifts includes performance of works on replacement, completion or replenishment of parts of a lift following an emergency case which rendered the lift out of service (earthquake, fire, etc.), or if the lift was rendered out of service due to improper maintenance or for another reason. Maintenance of lifts may be performed by a legal or natural person registered for this activity. On behalf of the owner, the rescue of persons from a lift is typically carried out by the maintainer of lifts.
